Terms and Conditions

Welcome to Stovold & Pogue. These terms and conditions apply to purchases made through our website and explain the terms on which we supply our products to you.

Please read them carefully before placing an order. By placing an order with us, you agree to these terms.

1. About us

This website is operated by Stovold and Pogue Limited, company number 08610228.

Our registered office is:

Stovold and Pogue Limited
Orchard Lea, Whiteball

Somerset

United Kingdom

Our contact email is [email protected].

2. Our products

We make every effort to ensure that product descriptions, measurements, photographs and colours shown on our website are accurate.

Colours can vary slightly between photographs, screens and the physical product.

Some of our products, particularly our stainless steel plate racks and shelves, are hand-cut, hand-finished or manufactured using traditional methods. As a result, there may be small variations in measurements, finish, alignment and appearance.

These characteristics are part of the nature and character of the products and are not necessarily faults. We will always make any significant or unusual characteristics clear in the product description before you place your order.

This does not affect your statutory rights. Goods supplied to consumers must still be of satisfactory quality, fit for purpose and as described.

3. Product assembly

Some of our products require self-assembly. Where this is the case, assembly instructions will be supplied.

Please read the instructions carefully before assembling your product and ensure that the appropriate fixings are used for the wall or surface to which the product is being attached.

Unless specifically stated otherwise, wall fixings are not supplied because the appropriate fixing depends on the type and condition of the wall.

4. Placing an order

When you place an order through our website, you are making an offer to purchase the products in your order.

You will receive an order confirmation by email acknowledging your order. The contract between you and us is formed when we accept your order and confirm that the goods are being processed for dispatch.

If we are unable to accept your order, for example because an item is unavailable or there has been an obvious error in the price or product description, we will contact you and refund any payment you have made.

5. Prices and payment

All prices shown on our website are in pounds sterling.

Delivery charges are shown separately before you complete your purchase.

We reserve the right to correct genuine pricing or product description errors. If an obvious error has resulted in an incorrect price being displayed, we will contact you before processing the order.

Payment is taken through the payment methods made available at checkout.

6. Delivery

Our current delivery arrangements, estimated dispatch times, delivery services and international delivery information are set out in our Delivery & Returns Policy.

The Delivery & Returns Policy forms part of the information provided to you before you place an order and should be read alongside these Terms & Conditions.

We aim to dispatch orders within the time stated in our Delivery & Returns Policy. Dispatch estimates are not guaranteed delivery dates unless we have specifically agreed a delivery date with you.

We will keep you informed if there is a significant delay to your order.

7. Risk and responsibility for goods

Your order remains our responsibility until it is delivered to you or to a person you have identified to take delivery on your behalf, unless you have arranged your own carrier independently of us.

Once the goods have been delivered, you are responsible for taking reasonable care of them.

8. Cancelling an order and returns

If you purchase from us online as a consumer, you normally have a statutory right to cancel your purchase without giving a reason.

Full details of how to exercise this right, the cancellation period, return arrangements, return postage and refunds are set out in our Delivery & Returns Policy.

Nothing in these Terms & Conditions limits or removes your statutory rights.

Where you exercise your statutory right to cancel, the relevant provisions of the Consumer Contracts Regulations apply. In general, the cancellation period for goods purchased online is 14 days from the day on which you, or someone you nominate, physically receives the goods.

9. Faulty, damaged or incorrectly supplied goods

If your goods arrive damaged, faulty or do not match their description, please contact us as soon as possible at [email protected].

We will work with you to resolve the problem in accordance with your statutory rights.

Depending on the circumstances, this may include repair, replacement, price reduction or refund.

We will not ask you to pay the cost of returning goods where they are faulty, damaged or incorrectly supplied.

10. Statutory rights

Nothing in these Terms & Conditions affects your rights under applicable UK consumer law.

In particular, the Consumer Rights Act 2015 provides protections relating to the quality, fitness for purpose and description of goods. These statutory protections cannot simply be excluded or restricted by our Terms & Conditions.

11. Our liability

We are responsible for losses that you suffer as a result of our breach of these Terms & Conditions or where we are otherwise legally responsible.

Nothing in these Terms & Conditions excludes or limits liability where doing so would be unlawful, including liability for fraud or fraudulent misrepresentation, or for rights and liabilities that cannot legally be excluded or limited.

If you are a consumer, nothing in these Terms & Conditions affects your statutory rights.

12. Website content

We make reasonable efforts to ensure that the information on our website is accurate and up to date.

However, we cannot guarantee that the website will always be available or free from errors.

15. Privacy

Any personal information you provide to us is handled in accordance with our Privacy Policy.

16. Changes to these Terms

We may update these Terms & Conditions from time to time.

Any changes will be published on this page. Changes will not affect an order that you have already placed where doing so would adversely affect your legal rights.

17. Governing law

These Terms & Conditions and any contract between you and us are governed by the law of England and Wales.

If you are a consumer living in Scotland or Northern Ireland, nothing in these Terms affects any rights you may have under the applicable law of your home jurisdiction.
